Welcome to the Black Magic Animal Rescue website.
These Terms and Conditions (“Terms”) govern your access to and use of the website operated by Black Magic Animal Rescue (“BMAR,” “we,” “our,” or “us”), including its pages, forms, applications, booking features, donation options, educational materials, online store, and other website services.
By visiting or using this website, submitting a form, making a donation, booking a service, or otherwise interacting with the website, you agree to these Terms and our Privacy Policy.
Please do not use the website if you do not agree to these Terms.
1. About Black Magic Animal Rescue
Black Magic Animal Rescue is a nonprofit animal rescue organization based in Casa Grande, Arizona. Our programs may include animal rescue, adoption, fostering, community-cat services, Trap-Neuter-Return or Rescue, trap rentals, pet food assistance, education, volunteer opportunities, fundraising, community support, and related services.
Information on this website is provided for general informational, educational, fundraising, and organizational purposes.
The availability, eligibility requirements, pricing, service areas, hours, and procedures for our programs may change based on funding, staffing, foster availability, veterinary availability, animal capacity, emergencies, public safety, and other operational considerations.
2. Eligibility to Use the Website
You must be at least 18 years old to submit an adoption, foster, volunteer, surrender, trapping, assistance, rental, service, or other legally significant application without the involvement of a parent or legal guardian.
Individuals under 18 may use general educational portions of the website with appropriate adult supervision.
Children under 13 should not independently submit names, photographs, contact information, or other personal information through the website. A parent or legal guardian must complete registrations and forms for children participating in rescue programs, educational activities, reading programs, or events.
3. Acceptance of Electronic Communications
By submitting a website form, checking an agreement box, creating a booking, making a payment, or selecting a button indicating your acceptance, you consent to conducting the transaction electronically.
You agree that electronic confirmations, notices, disclosures, acknowledgments, agreements, and records may satisfy any requirement that the communication be provided in writing, to the extent permitted by law.
You are responsible for providing a valid email address and telephone number and for keeping your contact information current.
4. Website Information
We make reasonable efforts to keep our website accurate and updated. However, we do not guarantee that all descriptions, photographs, animal profiles, appointment times, prices, program details, availability information, statistics, or other website content will always be complete, current, or error-free.
Information may be corrected, updated, removed, or changed without notice.
A typographical error, outdated page, technical issue, or incorrect listing does not require BMAR to provide an animal, product, service, appointment, or program benefit under the incorrect information.
5. Animal Profiles and Availability
Animal profiles are provided for informational purposes and do not guarantee that an animal remains available.
An animal may become unavailable because of:

An approved adoption or foster placement.

Medical or behavioral concerns.

Transfer to another organization.
-
Reunification with an owner.
-
A change in the animal’s needs.

A decision that placement is not currently appropriate.

Another animal-welfare or operational reason.
Descriptions of an animal’s personality, health, breed, age, weight, behavior, or history are based on the information reasonably available to us. Many rescued animals have incomplete or unknown backgrounds.
BMAR cannot guarantee an animal’s exact breed, age, adult size, genetic history, temperament, future behavior, health, compatibility, or suitability for a specific household.
6. Adoption Applications
Submitting an adoption application does not reserve an animal or guarantee approval.
BMAR may review factors including household composition, housing, landlord or property restrictions, current animals, veterinary history, references, lifestyle, animal-care plans, safety concerns, and the needs of the animal.
We may:

Request additional information.

Contact veterinarians, landlords, references, or household members.

Recommend a different animal.

Place an application on hold.
-
Decline an application.
-
Cancel or postpone an adoption.

Require an in-person or virtual meeting.

Require a separate adoption agreement.
Adoption decisions are made according to the animal’s welfare and the information available to BMAR. We are not required to approve an application solely because it was submitted first.
Approved adopters must sign BMAR’s separate adoption agreement and comply with its requirements. If these website Terms conflict with a signed adoption agreement, the signed adoption agreement will control for that adoption.
7. Foster, Volunteer, and Program Applications
Submitting a foster, volunteer, transport, trapping, community assistance, surrender, or other program application does not guarantee acceptance or participation.
BMAR may establish requirements related to age, training, experience, transportation, insurance, housing, availability, animal handling, background information, references, supervision, safety, or program capacity.
Some positions or programs may require additional agreements, waivers, orientations, identification, background checks, or training.
BMAR may suspend or end an individual’s involvement when reasonably necessary to protect animals, people, property, confidential information, or the organization.
Separate foster, volunteer, confidentiality, media, animal-care, or liability agreements will control when applicable.
8. TNR, Trapping, and Community-Cat Services
Submitting a request for Trap-Neuter-Return or Rescue, trapping assistance, transportation, trap rental, colony support, or related services does not guarantee that BMAR can accept or complete the request.
Service availability may depend on:

Location and service area.

Funding and appointment availability.
-
Weather and environmental conditions.
-
Volunteer and trap availability.
-
Property access and permission.
-
The number, behavior, condition, and location of the cats.
-
The cooperation of residents, caregivers, property owners, and businesses.

Veterinary capacity.

Safety and legal considerations.
Community-cat work involves unpredictable animals and outdoor conditions. Applicants, property owners, colony caregivers, and participants must follow all instructions provided by BMAR and the veterinary clinic.
No person may use BMAR services or equipment to harm, relocate, abandon, improperly confine, illegally remove, or otherwise mistreat an animal.
A separate trapping, TNR, property-access, veterinary, or trap-rental agreement may apply. That agreement will control if it conflicts with these general website Terms.
9. Trap and Equipment Rentals
Trap rentals or equipment loans are subject to availability, deposits, pickup requirements, return deadlines, and separate rental terms.
Borrowers are responsible for:

Using equipment only for its intended humane purpose.

Following BMAR’s trapping and safety instructions.

Protecting equipment from theft, weather, damage, and misuse.

Monitoring traps at the required intervals.
-
Never leaving an animal exposed to unsafe temperatures or conditions.
-
Returning equipment clean and by the agreed deadline.
-
Promptly reporting lost, stolen, damaged, or malfunctioning equipment.
Deposits may be withheld, and replacement or repair charges may apply, as described in the applicable rental agreement.
10. Appointments and Bookings
Appointments and consultations are subject to availability and confirmation.
Submitting a booking request does not necessarily mean the appointment has been accepted. An appointment is confirmed only after you receive confirmation from BMAR or the applicable booking platform.
You are responsible for providing accurate information and arriving or being available at the agreed time.
Cancellation, rescheduling, no-show, late-arrival, deposit, and refund rules may be displayed during booking or provided in a separate service agreement. Those specific rules are incorporated into these Terms.
BMAR may cancel or reschedule a booking because of an animal emergency, illness, severe weather, staffing limitations, veterinary changes, safety concerns, or other circumstances outside our reasonable control.
11. Surrender and Intake Requests
Completing a surrender or intake form does not mean BMAR has accepted custody or responsibility for an animal.
An animal remains the owner’s or caregiver’s responsibility unless and until BMAR expressly accepts the animal and any required surrender documents are signed.
BMAR may decline or postpone intake because of capacity, quarantine restrictions, medical concerns, foster availability, safety issues, financial limitations, or the needs of animals already in our care.
Applicants must provide truthful information concerning ownership, bite history, behavioral history, medical conditions, exposure to contagious illness, reproductive status, medications, and veterinary records.
12. Veterinary and Animal-Care Information
Website information about animal health, medication, feeding, behavior, trapping, recovery, or veterinary care is general educational information.
It is not a diagnosis, prescription, or substitute for advice from a licensed veterinarian.
Do not delay emergency veterinary treatment because of information found on this website or while waiting for a response from BMAR.
For a veterinary emergency, contact a veterinarian or emergency veterinary facility immediately.
BMAR does not guarantee the results of veterinary treatment, surgery, medication, fostering, rehabilitation, TNR, trapping, adoption, behavioral guidance, or other animal-care services.
13. Donations
Donations support BMAR’s charitable mission and may be used where they are most needed unless BMAR expressly agrees to a legally enforceable restriction.
Campaign descriptions, fundraising goals, photographs, and individual animal stories reflect the circumstances known when posted. Needs may change, animals may receive assistance from other sources, and funds raised beyond an individual case’s needs may be used for other animals, veterinary care, supplies, programs, or operational expenses consistent with BMAR’s mission.
Unless otherwise stated, donations are voluntary and nonrefundable. BMAR may consider a refund request involving a duplicate transaction, processing error, unauthorized payment, or other exceptional circumstance.
You are responsible for consulting your own tax professional regarding the tax treatment of a donation. No statement on the website guarantees that a particular payment, purchase, fee, or contribution is tax-deductible.
Third-party fundraising and payment platforms may have additional terms, processing charges, and privacy practices.
14. Purchases and Merchandise
Merchandise descriptions, images, prices, sizes, and availability may change without notice.
Colors and appearances may vary depending on the product, printing process, lighting, photograph, or device screen.
Orders may be limited, declined, corrected, canceled, or refunded because of inventory errors, pricing errors, suspected fraud, shipping limitations, or other reasonable concerns.
Any return, exchange, shipping, pickup, preorder, or refund policy displayed during the transaction is incorporated into these Terms.
Purchasing merchandise is not necessarily a charitable donation, and the tax treatment of a purchase may differ from the treatment of a donation.
15. Payments
Payments may be processed by third-party payment companies. By submitting payment information, you represent that:

You will pay all valid charges associated with the transaction.
BMAR does not generally receive or store complete payment card numbers when payments are processed through a third-party provider.
You remain subject to the payment processor’s terms and privacy policy.
16. Recurring Donations
By selecting a recurring donation, you authorize the applicable payment provider to charge the selected amount at the stated interval until the recurring donation is canceled.
You are responsible for updating expired or changed payment information.
Cancellation requests should be submitted before the next scheduled processing date. A cancellation may not reverse a payment that has already been processed.
Instructions for managing recurring donations may be available through the payment provider or by contacting BMAR.
17. User Submissions
You may submit photographs, animal information, adoption updates, testimonials, reviews, stories, comments, documents, or other content through the website or BMAR’s communication channels.
You represent that:

The content does not violate another person’s privacy or intellectual-property rights.

You have appropriate permission to submit photographs or information identifying another person.

Unless you clearly state otherwise, submitting content for publication, promotion, an adoption update, a testimonial, or a rescue story grants BMAR a nonexclusive, royalty-free permission to use, reproduce, edit, display, and share that content for rescue-related, educational, fundraising, and promotional purposes.
BMAR is not required to publish submitted content and may remove content at any time.
18. Prohibited Uses
You may not use the website to:

21. Events and Activities
Participation in an event, adoption event, educational activity, volunteer activity, trapping project, transportation assignment, or animal-handling activity may involve risks.
Participants must follow posted rules, staff instructions, venue requirements, and applicable waivers.
Parents and guardians are responsible for supervising minors.
Animals can behave unpredictably. Do not touch, feed, remove, open a cage or carrier, or handle an animal without authorization.
BMAR may remove a participant from an activity or event when reasonably necessary for safety, animal welfare, disruption, harassment, or failure to follow instructions.
22. Disclaimer of Warranties
To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis.
BMAR does not warrant that:

Separate agreements or waivers may establish additional responsibilities for adoptions, fostering, volunteering, events, trapping, transportation, equipment rentals, or other activities.
24. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Black Magic Animal Rescue and its directors, officers, staff members, volunteers, fosters, representatives, and service providers from claims, damages, losses, liabilities, and reasonable expenses arising from:

Before filing a legal proceeding, the parties are encouraged to make a good-faith effort to resolve the issue through written communication.

29. No Waiver
A failure by BMAR to enforce a provision of these Terms does not waive our right to enforce that provision later.
A waiver is effective only when made in writing by an authorized representative of BMAR.
30. Entire Agreement
These Terms and the Privacy Policy constitute the general agreement concerning use of the website.
Separate signed agreements, posted policies, booking conditions, payment terms, waivers, and program-specific rules may also apply.
When a specific signed agreement conflicts with these general website Terms, the specific signed agreement will control for the subject covered by that agreement.
31. Changes to These Terms
We may update these Terms to reflect changes in our website, programs, services, practices, or legal obligations.
Updated Terms will be posted on this page with a revised “Last Updated” date.
